1. Acceptance of These Terms
By accessing or using DispatchRewind, our websites, mobile apps, APIs, and related services (collectively, the “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of yourself or an organization you represent that you have authority to bind that organization to these Terms.
2. Critical Notice — Not for Emergency Use or Operations
The Service is not designed for, intended for, or permitted to be used for emergencies or emergency operations of any kind. This includes—but is not limited to—reporting emergencies, dispatching, incident command, life-safety coordination, medical triage, fire, police, public safety, disaster response, or time-critical communications.
Do not rely on the Service for any situation where a delay, failure, or inaccuracy could result in harm, injury, or death.
If you believe an emergency exists or you are in danger, call 911 (or your local emergency number) immediately.
We may suspend or terminate accounts or content that attempt to use the Service for emergency operations.
3. Eligibility
You must be at least 13 years old (or older if required by your country’s laws) to use the Service. If you are under 18, you must have permission from a parent or legal guardian. You may not use the Service if you are barred from doing so under applicable law or have been previously suspended or removed by us.
4. Your Account and Security
You’re responsible for your account, credentials, and all activity under your account. Keep your password secure and notify us immediately of any unauthorized use. We may offer multi-factor authentication; using it is strongly recommended.
5. Privacy
Our collection and use of personal data is described in our Privacy Policy (separate document that can be accessed by following this link: Privacy Policy). By using the Service, you consent to that collection and use.
6. User Content & License to Us
You retain ownership of text, images, audio, video, links, and other material you post, upload, submit, or otherwise make available through the Service (“User Content”).
You grant Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting/display only), adapt, publish, translate, create derivative works (for formatting/display only), distribute, publicly perform, and publicly display your User Content solely for the purpose of operating, improving, promoting, and providing the Service.
You represent and warrant that you have all rights necessary to grant this license and that your User Content and your use of the Service comply with these Terms and applicable laws.
7. Community Guidelines & Prohibited Conduct
You agree not to, and not to attempt to:
Use the Service for emergency operations or time-critical safety-of-life scenarios (Section 2).
Break the law or infringe third-party rights (including IP and privacy).
Post content that is illegal, exploitative, hateful, harassing, threatening, incites violence, or depicts sexual content involving minors.
Post others’ personal data without consent.
Post photos or videos that disclose the identity of any victims of any incident (e.g., EMS patient, motor vehicle accident victim).
Post photos, comments, videos or other content that violates your fire department's social media policy, if you are a member, employee, or otherwise affiliated with a fire department or company.
Spam; run scams; impersonate others; or misrepresent your affiliation.
Interfere with or disrupt the Service; bypass access controls; probe, scan, or test vulnerabilities.
Upload malware, viruses, or harmful code.
Scrape, crawl, or harvest data except as permitted by robots.txt or our explicit written permission.
Use the Service to build or improve competing services via automated means without our consent.
Interfere with emergency personnel and first responders operating at the scene of an incident.

We may remove or restrict content or accounts that violate these Terms or our policies, or as required by law.
8. Moderation and Enforcement
We may, but have no obligation to, monitor the Service. We may remove content, suspend features, or terminate or limit accounts for violations (actual or suspected), risk mitigation, legal compliance, or platform integrity. We are not liable for actions we take in good-faith moderation.
9. App Licenses; Mobile Platforms
Subject to these Terms, we grant you a limited, revocable, non-transferable, non-exclusive license to install and use our mobile app on devices you own or control. If you download the app from Apple’s App Store or Google Play, you acknowledge their terms also apply and that neither Apple nor Google is responsible for the Service’s maintenance, support, or legal claims beyond what their store terms require.
10. Intellectual Property
The Service (excluding User Content) and all related IP are owned or licensed by Company and protected by law. Except for the limited rights expressly granted, no rights are transferred to you. Do not copy, modify, distribute, sell, or lease any part of the Service.
11. Feedback
If you send ideas, suggestions, or feedback, you grant us a perpetual, worldwide, royalty-free license to use them without restriction or compensation.
12. Third-Party Services and Links
The Service may link to or integrate with third-party sites, services, or content. We do not control or endorse them and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk.
13. Communications; Notifications
We may send you Service-related notices (e.g., account, security, policy updates). You may control certain preferences in settings, but some administrative messages are required.
14. Availability; Changes to the Service
We may add, change, or discontinue features at any time. The Service may be unavailable due to maintenance, outages, or factors beyond our control. Do not rely on the Service for time-critical or emergency needs.
15. Beta Features
We may label some features as “alpha,” “beta,” or “experimental.” These may be unstable and may change or end at any time. You use them at your own risk.
16. Paid Features
If the Service includes paid features, you agree to the pricing, billing, taxes, and cancellation terms presented at purchase time. Except as required by law, payments are non-refundable. We may change fees with reasonable advance notice.
17. Termination
You may stop using the Service at any time. We may suspend or terminate your access immediately if you violate these Terms, present risk to the Service or others, or if required by law. On termination, your license ends, but Sections that by their nature should survive (e.g., IP, disclaimers, limits of liability, dispute resolution) will survive. We may retain and use information as permitted by law and our Privacy Policy.
18. Disclaimers
YOU USE THE SERVICE AT YOUR OWN RISK. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT.
Without limiting the foregoing:
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that data will be preserved without loss.
We do not warrant the accuracy or reliability of User Content.
The Service is not a substitute for 911 or emergency services and must not be used for emergency operations (Section 2).
Some jurisdictions do not allow certain disclaimers; some of the above may not apply to you.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow limitations of liability; some of the above may not apply to you.
20. Indemnification
You agree to defend, indemnify, and hold harmless Company and its affiliates, officers, agents, partners, and employees from any claim, demand, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your User Content; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party rights.
21. Export and Sanctions
You may not use or export the Service in violation of U.S. export laws or other applicable export and sanctions regulations.
22. Governing Law; Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Nassau, New York for any claims not subject to arbitration (if applicable).
23. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (e.g., via the Service or through our contact form if you’ve provided contact details). Your continued use after changes become effective means you accept the updated Terms.
24. Miscellaneous
Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
Assignment. You may not assign or transfer these Terms; we may assign them as part of a merger, acquisition, or sale of assets.
No Waiver. Our failure to enforce a provision is not a waiver.
Headings. Headings are for convenience and do not affect interpretation.
Notices. We may provide notices electronically (in-app, by posting to our site) or via the contact information you provide.
